That's the CD I got when I bought the game. I was able to install patch 1.23 and the list servers patch without any trouble. It's rather odd that you're having trouble.
And to be off topic, the game contained two preview videos, Fly!, or as I like to call it, Die!, and Railroad Tycoon 2, a.k.a. Snailroad Tycoon 2. Yeah, I sometimes like renaming crappy stuff. The box also was supposed to contain JJ1, but instead I got a note inside from GOD Games saying "Sorry, we forgot to put JJ1 in the box. Call us to have us send it to you free of charge." Of course, I called them to no avail. Looks like I have to buy JJ1 seperately. :P
