Why Cliff? Epic Games could start the development over again because they probably still keep all rights on Jazz Jackrabbit and they obviously have all rights on Unreal Engine. If they are not working on new Jazz game, they are not interested
Also, about UDK usage, as was stated above - community can make something UDK-based, still it will be copyrighted by Epic. A mediocre project can buy a licence, but sine Jazz is copyrighted by Epic too, fan-game can't have an official status without Epic permission. The only chance is to win a Make Something Unreal award, but it's too late to think about it (at the moment of UDK release this year's MSUC already was close to final; it's unknown when is the next one). It's not hard, though it requires serious work on project.
