Yes, ET's game was illegal. Nobody cares because it is no threat to business at any of JJ2's producers. An entirely new game would be. Otherwise people could be running around, stealing things, any saying "Oh, but I'm a fan of this!" and it would be legal. This would be more than a fangame.
