Yeah, and even if you were truly serious about buying the rights, as long as they (epic) are still even thinking about a Jazz 3 in the back of there mind, or a gameboy version, the rights would be pretty expensive. Maybe you could make a game, bazz backrabit, and change all the character names, appearances, plot, etc. but still use the same concept and other things, such as baddies, I doubt anyone would care, as long as you don't sell it, and you give epic some credit, but I am no expert on this.
